VEETHEE VIHARAN Pvt. Ltd., a private limited company incorporated under the laws of India having its registered office at Farm Chandrakanta, Chandrika Devi Road, Kathwara, Bakshi Ka Talab, Lucknow, India, operating www.EATIND.com (hereinafter referred to as the “VEETHEE VIHARAN” or “we” or “us” or “our”).

These Terms and Conditions (“Terms”) are a binding legal agreement between you and VEETHEE VIHARAN that govern your right to use the websites, applications, and other offerings from VEETHEE VIHARAN (collectively, the www.EATIND.com or VEETHEE VIHARAN platform).

VEETHEE VIHARAN is engaged in the business of providing e-commerce marketplace in the name of VEETHEE VIHARAN (portal / website) wherein the HOST and CUSTOMERS directly sell and purchase the services respectively. The VEETHEE VIHARAN Platform offers an online venue that enables HOST and CUSTOMERS to publish or list, offer, search for, and book services.

‘HOST’ means and includes a person in possession of the premises or equipment or  control over such premises or equipment and also includes its agent or manager or the person to who such responsibility is assigned by the lawful owner. The HOST lists the services or offerings on the VEETHEE VIHARAN platform.

‘CUSTOMER’ (‘visitor’, ‘customer’, “you/your”) includes you, and anyone else in your accompanying you including friends, relatives, spouses, significant others, any minor children, and any other occupants under your custody, care and control, regardless age or the amount of time you or anyone else occupies or uses any and all activities related to the rental, operation, or use of equipment provided by adventure in owner place. The customer search for and book Host services by using VEETHEE VIHARAN platform.

‘Host Service’ means the services which the HOST offers on VEETHEE VIHARAN portal or makes available on or in connection with the VEETHEE VIHARAN portal – including but limited to food and dining services offered by HOST, visiting the premises of HOST, using the vehicles such as ATV rides, bicycles, terrain etc. provided by HOST for the purposes of entertainment and other services which are offered for listing on VEETHEE VIHARAN portal;

You must register an account to access and use many features of the VEETHEE VIHARAN Platform, and must keep your account information accurate. As the provider of the VEETHEE VIHARAN Platform, VEETHEE VIHARAN does not own, control, offer or manage any Listings or Host Services. VEETHEE VIHARAN is not a party to the contracts entered into directly between Hosts and Customers. VEETHEE VIHARAN is not acting as an agent in any capacity for any HOST or customers. The booking made by you using the portal would lead to a principal to principal contract or agreement directly between you and the HOST.

BY ACCEPTING THESE TERMS AND CONDITIONS THE CUSTOMER IS BOUND BY THE FOLLOWING :

1.   CONFIRMATION OF BOOKING :

VEETHEE VIHARAN would take the bookings after receiving the entire amount displayed on the portal and would be payable in advance by the customer. However, such booking or receipt of the amount by VEETHEE VIHARAN shall not be treated as confirmed unless it is confirmed by a confirmation mail or message from VEETHEE VIHARAN. The invitation for offer from your end has to be confirmed by the HOST. Once the booking is accepted by the HOST, VEETHEE VIHARAN would send a confirmation mail or message to the CUSTOMER regarding the confirmation of your booking.

2.   PAYMENT INFORMATION:

We accept all major credit and debit cards and UPI Id payments. However, the deduction of amount from your account shall not automatically mean that your booking has been confirmed. Kindly refer – CONFIRMATION OF BOOKING clause mentioned above for further detail.

3.   That the VISITOR understands that the service agreement is between the HOST and the Customer. Further, the booking through the VEETHEE VIHARAN platform does not create any agency relationship of VEETHEE VIHARAN with the HOST. The Customer acknowledges that the arrangement between the CUSTOMER and HOST is on Principal to Principal basis.

4.   LOST AND FOUND: EATIND is not responsible for personal items lost or stolen during your visit or items left in the premises of the HOST. You are responsible for your own belongings.

5.   RISKS LIABILITY :

The Customer agrees that he / she is visiting the premises or availing of services such as renting, operating, using the vehicles/quad bikes/ tractors/ other gadgets/ equipment/ machines etc, provided by the HOST at your own risk. The Customer agrees that he/she is voluntarily participating in all activities and assumes all risk of injury, illness, damage, or loss that might result, even if the risks arise out of the negligence or fault of adventurer, which may be both foreseen and unforeseen.

The Customer further undertakes to take proper care and protect the gadgets, equipments/ machines/ quad bikes/ tractors/ vehicles etc provided by the HOST and the premises of the owner including but not limited to the antiques, photographs, decorative items etc fixed or kept in the premises during his visit to the Owner premises.

The Customer also agrees that the vehicles or machinery or equipment etc brought to the premises of the HOST would be sole responsibility of the Customer and the customer undertakes to assume all risk of damage to such vehicle or machinery or equipment etc. and VEETHEE VIHARAN or the HOST would not be responsible to any such damage or personal injury or any injury to the third party.

6.   INDEMNIFICATION

In case of damage to the property (movable or immovable), fixtures, fittings, antiques, decorative items, equipment etc the visitor would be liable to pay damages to the Host. The amount of damages as decided by the Host would be final and binding upon you. The customer undertakes to hold VEETHEE VIHARAN harmless in this regard.

7.   Liability:

The customer agrees that the HOST or VEETHEE VIHARAN shall not be liable for any damages arising from personal injuries sustained by the Customer, any minor children, and any other occupants under the visitors custody, care and control, as a result of any and all activities related to the rental, operation, or use of equipment provided by the owner.

The customer assumes full responsibility for any such injuries or damages which may occur, and further agrees that the HOST or VEETHEE VIHARAN shall not be liable for any or theft of personal property.

8.   LIABILITY TO THIRD PARTIES:

The visitor agrees that he/she will indemnify and hold harmless the HOST and VEETHEE VIHARAN for all personal injuries, property damages, or any other damages to any and all third parties, including, but not limited to the occupants of the premises.

9.   DISPUTES RESOLUTION:

This Agreement will be governed by the laws of India. Any dispute or claim of any nature relating in any way to your use of any Services covered under this Agreement will be adjudicated through arbitration, by a sole arbitrator to be appointed by the consent of both the parties. The arbitral proceedings shall be conducted in accordance with the provisions of the (Indian) Arbitration and Conciliation Act, 1996 or such statutory amendments thereof (“Arbitration Act”). The arbitration proceedings will be conducted in English and the seat or venue of the arbitral proceedings shall be Lucknow (U.P), India. Each party agrees that courts in Lucknow will have the sole and exclusive jurisdiction over all arbitral applications. 

This Agreement shall be governed by and construed in accordance with the laws of India. The adjudication of any dispute will be the exclusive jurisdiction of the courts of Lucknow.

10.               REFUNDS

The customer understands that the HOST has to do arrangements for the services upon confirmation of booking and any cancellation near to the ‘date of event’ (day on which the services are to be provided by HOST to Customer) would lead to unnecessary loss to the HOST. Our refund policy is based upon this principle and accordingly any refund would arise only and only in a situation where you cancel the confirmed booking prior to 24 hours of the date of event.

11.               ACTS OF GOD AND NATURE

VEETHEE VIHARAN will not refund any portion of your amount in the event that your reservation is affected by an act of god including but not limited to pandemics, epidemics, major storms or weather events.

12.               RESERVATION CHANGE

If you must change or reschedule  your reservation for any reason, you may do so at least  24 hours prior to your original arrival date. changes made to your  reservation  less than 24 hours prior to your arrival date will be treated as a cancelled reservation.

13.               CANCELLATION

If you cancel your reservation, please notify us at least  24 hors prior to your arrival date. Your deposit will be refunded and in cases where there is any deduction of fees by the HOST, the actual amount would be deducted while granting refund. Any cancellation request received less than 24 hours prior to your arrival are non-refundable and subject to forfeiture of total payment. All cancellation fees and refund are subject to applicable taxes. 

14.               SAY NO TO PLASTIC

Please do not carry plastic bags or polythene inside the OWNER’s premises. The owner does not encourage one to bring along plastic and litter them in and around the campus.

15.               NO OUTSIDE FOOD & DRINKS

Outside food and beverages are not allowed inside the OWNER’s premises. Further, consumption of alcohol, drugs etc are prohibited and any such use would attract penalty as per law of the country (like Excise Act, NDPS) by the appropriate authorities. Host or VEETHEE VIHARAN shall not be liable for any penal action taken against the customer for such violations. The customer shall indemnify Host and VEETHEE VIHARAN for any such penal actions against him by lawful authorities.

16.               NO DISTURBANCE

Inside the premises, under any circumstances one is discouraged to play loud music or make noise. Radios, Speakers (Bluetooth or Mobile Phones) are discouraged to be used inside the premises so as to cause disturbance to other visitors or neighbourhood.

17.               PARKING SPACES

The parking spaces for vehicles would be available on first come first serve basis. The visitor undertakes to park their vehicle at their own risk and the owner would be held responsible liable for any theft, damage etc.

18.               COMPLIANCE OF OTHER LAWS

You shall abide with all the applicable laws of the country like Prevention of Cruelty to Animals Act, 1960 etc. You shall be solely liable for any liability/ penalty which may arise due to breach of any provision of law. You undertake to hold HOST and VEETHEE VIHARAN harmless for penalty or liability arising on such account. 

19.               PRESERVING THE NATURE

You are further advised NOT to pluck flowers or break the leaves of any plants of trees in an around the premises. Any person found doing such activity shall be eligible for strict action against them by the owner including immediate termination of this agreement.
